Deal on 9/11 Briefings Lets White House Edit Papers

..."Two Democrats on the 10-member panel say
that the commission should have demanded full access to the
intelligence summaries, known as the President's Daily Brief, and
that the White House should not be allowed to determine what is
relevant to the investigation.
"An umbrella group of victims' families joined the criticism, saying
the terms of the accord should be public.
..."A Democrat on the panel who has criticized the accord, former
Representative Timothy J. Roemer of Indiana, said in an interview
that he believed that the panel had agreed to terms that would let
the White House edit the reports to remove the contexts in which the
intelligence was presented and to hide any "smoking guns."
..."The other Democratic critic on the panel, former Senator Max Cleland
of Georgia, has described the agreement as unconscionable.
..."In its statement, the victims' family group, the Family Steering
Committee, said the agreement would "prevent a full uncovering of
the truth and is unacceptable." The group is led by many advocates
who were most responsible for pressuring Congress to create the
commission last year over the initial objections of the White House.
"As it now stands, a limited number of commissioners will have
restricted access to a limited number of P.D.B. documents," the
group said. "The commission should issue a statement to the American
public fully explaining why this agreement was chosen in lieu of
issuing subpoenas to the C.I.A. and executive branch."
"The group said, "All 10 commissioners should have full, unfettered
and unrestricted access to all evidence, including but not limited
to all Presidential Daily Briefings."
"A spokesman for the group, Kristen Breitweiser, whose husband,
Ronald, was killed at the World Trade Center, said the families were
alarmed that the terms of the accord were kept secret.
`'I think this entire deal needs to be explained to the public," Ms.
Breitweiser said. "This is an independent commission that is
supposed to be transparent, that is supposed to be open."

"Relatives of Sept. 11 victims criticize agreement between White House and
commission" by LAURENCE ARNOLD, AP, 11/13/03
"Relatives of people who perished in the Sept. 11 attacks say a
federal commission accepted too many conditions in striking a deal with the
White House over access to secret intelligence documents.
"The Family Steering Committee, a group of victims' relatives who are
monitoring the work of the independent commission, criticized the agreement
announced late Wednesday. Under the deal, only some of the 10 commissioners
will be allowed to examine classified intelligence documents, and their
notes will be subject to White House review.
""All 10 commissioners should have full, unfettered and unrestricted
access to all evidence," the group said in a statement Thursday. It urged
the public release of "the full, official, and final written agreement."

Thompson are Republicans.

..."commissioner Tim Roemer, a former Democratic congressman from
Indiana, said that the terms of the deal -- which he declined to elaborate
-- were too restrictive. "To paraphrase Churchill," he told UPI, "Never
have so few viewed such important documents under so many restrictions." "I
have deep reservations and doubts about this deal," he concluded.
..."Many of the relatives of those killed on Sept. 11 -- who
campaigned to have the commission established in the first place -- said
they, too, were unhappy with the agreement.
""Why is it necessary to exclude any of the commissioners?" asked
Patty Casazza, who lost her husband John. "They all have the highest level
of clearance."
""If the commission believes this is such a good deal, why don't they
publish the terms," added Mindy Kleinberg, whose husband Alan was killed.
"The public should have the right to reach their own judgment about whether
this is a good deal, or whether the commission should have used its
subpoena power."
..."A source familiar with the terms of the agreement told UPI on
condition of anonymity that sub-committee members would face "a plethora of
restrictions" -- including on note-taking, and on what could be reported
back to the full commission.
"Ben-Veniste defended the deal as the best the commission could get,
given that it faced a *CONGRESSIONALLY MANDATED DEADLINE OF MAY 27* to
present its report.

The deal they cut was that only 2 or 4 of the Commissioners would be able to

Also, they could only take notes about them, and then they would have to get
White House approval before they could tell the other commissioners what
their notes said.
